Legal Expert Service
Scope of Works
The purpose of this Scope of Work (SoW) is to seek the legal advice from the local expert to support YCP in ensuring the compliance with relevant laws and regulations to achieve an efficient, high standard of YCP’s institutional legal aspects.
The selected local legal expert will conduct a thorough review, comprehensive feedback related to the implementation of prevailing Foundation Law (UU Yayasan), Labor Law and other relevant regulations to ensure smooth operations in YCP, develop key policies/Standard Operating Procedure (SOP)/guideline in managing legal administration in YCP, and if needed, perform independent research and analysis of specific legal issues as well as broader sectors of the national legal system that is supporting YCP’s values and strategic objectives.
In performing the required assignment, the selected local legal expert will work under the supervision of Director of Support Operation and in coordination with the Chief Executive Officer of YCP.
Expected Key Deliverables
The selected candidate will deliver services with the following objectives:
- Completion of the Amendment of YCP Deed of Establishment including the operational permit and license;
- Key policies/SOPs/guidelines on managing relevant legal administration process for Yayasan, including improved standard format of legal documents such as employee agreement, vendor contract and forms;
- Technical report on selected legal issue where relevant with YCP strategic objectives, including the risk mitigation and legal advice for YCP in adoption of CARE global policies within the context of Indonesia legal framework.
Timeline
The selected candidate will work within the period of 3 (three) months, starting from February to April 2021.
Duties and Responsibilities
- YCP Institutional Statutory:

- Responsible for completing the Amendment of YCP Deed of Establishment and renew the operational permits and licenses to reflect the approved changes;
- Develop key policies/SOPs/guidelines on managing organization bylaws, Board Manuals, and other legal administration process in YCP in compliance with the prevailing laws and regulations.
- Improvement of YCP Legal and Contract Management:

- Coordinate with HR and Procurement to review and revise the existing legal documentation to reflect the ratified CARE’s global policies.
- Others:

- Conduct independent study and risk mitigation on selected projects that support to YCP strategic objectives within the context of Indonesia legal framework.
Qualifications
- Individual with notarial laws background with solid understanding in Foundation laws, Manpower laws and other relevant regulations.
- Experience in dealing and managing the legal aspects of not-for-profit organizations such as Yayasan, within the context of Indonesia legal system is a must.
- Good knowledges on local cultures and appropriate manner.
- Ability to think analytically and critically, especially on complex legal matters to provide reasonable solutions.
- Excellent skills to write clear and concise report (i.e. study paper, policy, SOP, guideline) in Bahasa/English.
- Having previous research experiences and/or publications on public laws is preferable.
